TERMS AND CONDITIONS OF SALE & USE FOR BLUESTONE ART

The Terms and Conditions set out below apply to all transactions on this website, please read through these carefully before placing an order. Our policies are subject to change at any time without notice. Nothing stated or implied on this page will affect your statutory rights.

PURCHASE AND AVAILABILITY

To purchase from us you must be over 18. Bluestone Art reserves the right to refuse access to our websites, terminate accounts, terminate transactions, and remove or change the content at our sole discretion. If we cancel a transaction, it will be without charge to the customer.

All orders placed on our website will automatically receive a confirmation e-mail of the transaction. It is the customer’s responsibility to check any email filters that may interfere with our communication to you.

​

All goods are sold subject to availability. In the event that we are unable to supply the goods, we will inform you by telephone or email of this as soon as we possible, normally within 48 hours. A full refund will be given where you have already paid for the goods and the transaction will be cancelled. Should you wish to choose another item of the same value this is acceptable.

​

POSTAGE

Prices do not include postage and packing which will be charged as an additional cost on all orders that are applicable. Our postage rates page is Delivery £15.00 inc VAT for orders less than £100.

Free UK delivery for all orders over £100 Please note that the appropriate delivery charge should be shown on the order confirmation page of the checkout.

DELIVERY TIMES

Items are usually dispatched via Courier within 2 working days or less, the item will also need to be signed for by the recipient.

​

Please advise us if you do not receive your item(s) within 7 days of placing your order so that we can trace the parcel. If we know in advance that an item will take longer than 10 working days to deliver to you, we will inform you as soon as possible. Delays occasionally take place due to circumstances beyond our control, including Courier and/or Supplier problems and this will affect delivery times. We may also deliver the goods in several consignments but will not charge any extra delivery for this.

PRICING

The price you pay is the price displayed on this website at the time we receive your order, plus the cost of Shipping and Handling. However errors and omissions are excluded, therefore we reserve the right not to send an item if we make a pricing error. Sometimes we sell the same items at higher or lower prices elsewhere. We reserve our right to do this. Our trading currency is GBP.

RETURNS & REFUNDS

If for any reason you are unhappy with your goods or simply change your mind you have the right to cancel your order within 14 days for a full refund (you will have to cover the cost of return postage) the 14 days commence the day after receipt of the goods, you then have a further 14 days in which to return the goods back to us. This is your statutory ‘cooling-off period’. A full refund for the price you paid for the item will then be issued. To cancel your order you can e-mail us, quoting your order number, and product name. You must take reasonable care of the items and must not use them. The item must be in its original condition, unopened (with any seals and shrink-wrap intact) and undamaged. Goods which cannot be resold as new will be rejected for refund. After 14 days we reserve the right to refuse unwanted goods, or at our discretion, take the goods back and charge you a re-stocking fee.

DAMAGED OR DEFECTIVE GOODS

Under the Consumer Rights Act 2015, you have the right to reject goods that are of unsatisfactory quality, unfit for purpose or not as described, and get a full refund. This right is limited to 30 days from the date the customer took ownership of the goods. If an item is faulty and needs to be returned, the customer does not need to pay postage costs for the return of the faulty item. If a customer is asked to return an item that arrived damaged, not as described or faulty, the retailer should refund the total cost of the return.

RETURNING YOUR ITEM

Please contact us for the appropriate returns delivery address and procedure. You are responsible for returning the goods to us. You must take reasonable care of the goods. We usually ask that items are wrapped securely & safely for transit, in the original packaging or that the original packaging be included. We advise that all returned items are sent by recorded & insured post, as we are not responsible for un-received goods, nor are we responsible for claiming damages from a courier if goods are damaged in transit on their way back to us. You should always contact us if you are unsure of the returns process. Returns must be accompanied by a copy of the invoice (if appropriate) so we can process it. We will notify you via email when we have processed your return & refund and this can take up to 3 weeks.

Where Bespoke Framed Orders have been supplied correctly, we are unable to offer refunds or exchange.

​

DELIVERY CHARGES & OTHER SERVICES

If you are returning an item because of an error on our part or because it is damaged or defective, we will both refund the delivery charges incurred in sending the item to you originally and your costs in sending them back (you will need to provide proof of costs). Where you are returning your item for a refund within the 7 working days cooling-off period, we will not refund any postage charges for the delivery of that item. You will be responsible for those charges and the costs of any other services provided to you.

SPECIAL OR EXCEPTIONAL GOODS

Some items are automatically excluded from our standard returns policy (unless they are damaged or defective) because, for example, they may have been specially purchased by ourselves in order to fulfil your order.

PRIVACY & DATA PROTECTION

We will take all reasonable precautions to keep the details of your address, order and payment secure and the customer must also do the same. Unless we are negligent, we cannot be held liable for any loss or damages caused as a result of unauthorized access to information provided by you.

If we have reason to suspect that your details have been obtained fraudulently from us, we will endeavour to let you know as soon as we can.

The Data Protection Act 1998 applies. You may write to the data controller at our place of business above, in order to query what data is held about you. Please contact us at the appropriate address.

MARKETING POLICY

By purchasing and putting your email & address on our website you, in turn, agree that we can send you marketing and offers through email and the post. If you do not wish to receive such offers please email us through our ‘Contact Us' page and ask for your email and/or address to be removed from our database. We will then remove the requested information.

By contacting us through the email you also agree to be sent marketing emails and offers but you can opt out from receiving such emails by following the instructions within those emails or again by using our ‘Contact Us’ page.

COMPLAINTS

We take complaints very seriously. If you feel that we really have fallen short of your expectations, please mail  sales@bluestoneart.co.uk and I will listen to what you have to say.

CUSTOMS

Any International Tax, Customs & Import Duties are not included. The customer is solely responsible for the payment of any surcharges.

COPYRIGHT CLAIMS

Bluestone Art respects intellectual property rights. If you believe that your work has been copied in a way that amounts to a copyright breach, please contact us.

TRADEMARKS & COPYRIGHTS

Bluestone Art, Speedframe and other marks indicated on our website are trademarks or registered trademarks of Speedframe (Lincoln) Ltd in the European Union and/or other jurisdictions. Bluestone Art graphics, logos, page headers, button icons and other similar items, are the trademarks or trade dress of Bluestone Art; these may not be used in connection with any product or service or website that is not Bluestone Art, in a way that is likely to cause confusion or that disparages or discredits Bluestone Art. All other trademarks not owned by Bluestone Art that appear on this website are the property of their respective owners.

All content, compilations of content and software used on this website, e.g.: text, graphics, logos, images, data compilations and software is the property of Bluestone Art and its affiliates or its content suppliers and is protected by the United Kingdom and international copyright and database right laws.

EVENTS BEYOND OUR REASONABLE CONTROL

Bluestone Art will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.

LAW AND JURISDICTION

The contract shall be deemed to be made in England. All Contracts made between us and the Customer shall be governed by the laws of England and any dispute arising therein shall be subject to the sole jurisdiction of the English courts.
